CJCC Demands Oversight Hearings as Insurers Target Litigation Funders Critical to Sexual Abuse Survivors’ Claims


Chubb and Marsh McLennan Conducting Coordinated Campaign to Undermine CVA and ASA Cases in New York

Albany, NY  The Coalition for Just & Compassionate Compensation (CJCC) is calling on the New York State Legislature to hold oversight hearings into what it describes as a coordinated campaign by Chubb Insurance and Marsh McLennan to block sexual abuse survivors from accessing justice, including by targeting the litigation funding infrastructure many depend on.

“Litigation funders help level the playing field for victims who would otherwise be unable to access justice through the courts,” said James Marsh, CJCC Trustee and a nationally recognized attorney who has represented hundreds of survivors. Marsh added,

“The institutions responsible for abuse have insurance coverage for exactly this reason. But instead of honoring their obligations, companies like Chubb are trying to choke off survivor claims by threatening the very financial tools that make these cases possible. That’s not just bad faith—it’s a direct attack on the right to be heard.”

In a letter to Senator Jamaal Bailey and Assemblymember David Weprin, chairs of the Senate and Assembly Insurance Committees, CJCC detailed a broader strategy being deployed by insurers: delay coverage, deny liability, refuse to negotiate—and now, sever ties with any law firm or financial partner that works with litigation funders.

Chubb’s CEO recently announced that strategy publicly, following the failure of a federal attempt to impose tax penalties on funders. “This is a calculated move,” said David Catalfamo, CJCC Executive Director. “Having failed in Congress, the industry is moving state by state to suppress litigation before it starts.”

CJCC also criticized the Hochul administration and the Department of Financial Services for refusing to enforce existing guidance against unfair claims practices. “DFS has remained silent as survivors are systematically locked out of court by financial obstruction,” said Catalfamo. “That leaves the Legislature as the last line of defense.”
