In Major Court Hearing Today, CHUBB Insurance Continues to Delay Justice & Put Shareholders & Profit Over Survivors

Following today’s hearing in case of Chubb v. the Archdiocese of NY, court to decide if Chubb’s precedent setting lawsuit to evade paying a single Archdiocese related CVA claim is allowed to move forward

NEW YORK, NY (November 27th) – This morning, a key hearing between Chubb Insurance and the Archdiocese of New York took place as part of a lawsuit that will determine whether or not Chubb is legally obligated to pay insurance claims for child sexual abuse survivors. The hearing continued a pattern of Chubb’s attempt to evade responsibility for their obligations at the expense of survivors, all while raking in record profits. The outcome could have significant precedent setting implications for whether insurance carriers will be able to evade contractual obligations to their policyholders over sex abuse cases.

The case was brought by Chubb against the Archdiocese of New York in a brazen effort to skirt their contractual obligations to pay survivors of child sex abuse the restitution that they deserve – with Chubb claiming they don’t have responsibility for a single insurance obligation in any CVA cases involving the Archdiocese. As survivors await a ruling, the Coalition for Justice and Compassionate Compensation – an independent alliance of survivors of child sexual abuse, their representatives, and advocates – released the following statement: 

“Chubb’s tactics have never been clearer, as they continue to deny responsibility, delay justice, and put record profits over restitution for child sexual abuse survivors,” said David Catalfamo, Executive Director of the CJCC. “This lawsuit is part of a state and national pattern attempting to wash their hands of responsibility to child sexual abuse survivors and would have profound implications for all survivors not only in NY, but across the country. If successful, Chubb’s lawsuit would tie up CVA cases for years and set a dangerous precedent, creating a roadmap for other insurers to deny coverage. We won’t sit back as a multi-billion dollar insurance giant tries to flat-out deny coverage for more than 1,300 survivors in a craven attempt to fatten their bottom line.”
